01 Introduction
These Google Pay Terms and Conditions (“Terms”) are an agreement between you and Volt Pay governing your access to and use of an eligible Volt Pay Card through Google Pay. By adding a Volt Pay Card to Google Pay on an Android Device, or by permitting an Authorized User to add a Volt Pay Card linked to your Card Account, you confirm that you have read, understood, and accepted these Terms.
If you do not agree to these Terms, you must stop using your Volt Pay Card with Google Pay and remove each Volt Pay Card linked to your account from Google Pay.
These Terms supplement the Volt Pay Terms of Use applicable to each Volt Pay Card (the “Agreement”). You should read both documents together. If there is any inconsistency concerning access to or use of a Volt Pay Card through Google Pay, these Terms will prevail to the extent of that inconsistency.
Your use of Google Pay is also subject to the terms and conditions established by Google. Google’s terms do not change or override these Terms.
02 Eligibility / Enrollment
Google Pay may be used by eligible Volt Pay Card cardholders to purchase goods and services with an eligible Android Device at merchants that accept Google Pay, including NFC-enabled and online merchants.
To add a Volt Pay Card to Google Pay, you must register the Card through the Volt Pay application or enter or scan the Card details in Google Pay (“Google Pay Card Registration”). We may require additional authentication, including a one-time password sent by SMS to the mobile number registered with us. Enrollment may be declined if the Card is ineligible, authentication is unsuccessful, or the Card or underlying Card Account is not in good standing. Google may limit how many cards can be stored on an Android Device. We may also limit the number of Android Devices on which the same Volt Pay Card may be stored.
Where a Program Account includes multiple Volt Pay Cards, each Card is treated separately and must complete its own Google Pay Card Registration and authentication.
When a Volt Pay Card is added to Google Pay, a unique numerical identifier different from the Card number (“Device Card Number”) may be assigned for purchases and refunds. You may need to present the Android Device used for a purchase when returning an item.
After registration, Google Pay may be used to authorize transactions on a Card Account by presenting the relevant Android Device at a contactless terminal or through an application on that device.
Renewal of an expired Card or replacement of a damaged Card may not affect the enrollment of that Card in Google Pay, whether or not the renewed or replacement Card has been activated.
03 Your Use of Volt Pay Cards through Google Pay
You must keep your Android Device secure. Lock it when it is not in use or unattended, install current security software where applicable, and do not modify it contrary to the manufacturer’s software or hardware guidelines or disable its controls, commonly referred to as rooting or jailbreaking.
Using a modified device with your Volt Pay Card and Google Pay is prohibited, violates these Terms, and may result in access to the Card through Google Pay being denied.
You must protect every passcode or personal identification number used to access your Android Device or authorize purchases through Google Pay as carefully as a banking password or PIN. In particular, you must:
- not disclose or share it with any other person;
- not keep an unprotected record of it with the Android Device or anything likely to be stolen with the device;
- not choose an easily guessed passcode, such as a date of birth or recognizable part of a name; and
- take reasonable care to protect its security.
You must take reasonable steps to prevent fraud, loss, or theft involving your Android Device or any Volt Pay Card used with Google Pay.
If biometric identifiers are used to unlock your Android Device or authorize use of your Volt Pay Card through Google Pay, you must not register another person’s biometrics on the device. If you do, and those biometrics can be used to access the device or the Card, you will be treated as having authorized that person to transact on your behalf and will be responsible for those transactions.
Biometric information, PINs, and passcodes used by Google Pay are collected, stored, enrolled, matched, and verified through technology on your Android Device. We do not control that technology or its availability, security, integrity, capability, or verification methods. You should assess whether those methods and their associated risks are acceptable to you.
Use of Google Pay is optional and at your discretion. Access to and use of a Volt Pay Card through Google Pay will be treated as authorized by you. If you share a passcode or permit another person’s biometric identifier on your device, transactions initiated using that credential will be treated as authorized by you and provisions of the Agreement addressing unauthorized transactions may not apply.
If your Android Device is lost or stolen, a credential is compromised, or a Volt Pay Card is used through Google Pay without permission, you must notify us immediately. We may require a statutory declaration, police report, or other information reasonably necessary to investigate.
You may be liable for unauthorized use until you notify us, unless we determine that you complied fully with these Terms, notified us without delay, assisted with investigation and recovery, did not act fraudulently, and the transactions did not result from your willful misconduct or gross negligence.
Transaction history shown in Google Pay reflects authorization activity on that Android Device and may not show later clearing, settlement, foreign exchange, refunds, returns, or chargebacks. The amount, currency, or other details may differ from the amount ultimately posted to your Volt Pay Card statement. If there is any inconsistency, the Card statement prevails.
04 Fees and Charges
Fees, interest, and charges applicable to your Volt Pay Card under the Agreement continue to apply after the Card is registered with Google Pay. We do not currently impose an additional fee for using a Volt Pay Card through Google Pay, but we reserve the right to introduce a fee in the future. You are responsible for third-party charges associated with Google Pay, including data usage, web access, or text messaging charges imposed by a telecommunications provider.
As a condition of using your Volt Pay Card with Google Pay, you consent to receiving notifications, automatically dialed calls, or text messages on the relevant Android Device or the mobile number registered with us, as permitted by applicable law.
05 Suspension and Termination of Google Pay
We may suspend, block, or cancel your ability to use a Volt Pay Card with Google Pay at any time, subject to applicable law. This includes changing permitted transaction types, Card eligibility, or authentication requirements.
We may set limits on daily or individual transaction amounts charged through Google Pay and notify you of those limits from time to time.
If a Volt Pay Card is canceled or suspended under these Terms or the Agreement, you may no longer use it through your Android Device even if an image or symbol for the Card remains visible on the device.
06 Authorization to Collect and Share Data
You agree that we may collect, transmit, store, and use technical, location, login, and other information about you, your Android Device, and your use of a Volt Pay Card through Google Pay. Device information may include the application version, device type and model, operating system, and security status, including whether root access has been obtained. We may use this information:
- to ensure the Volt Pay Card functions properly in Google Pay;
- for security and fraud prevention;
- to provide support and assistance; and
- to inform you about products or services that may be of interest, where permitted by applicable law.
You acknowledge that Google and its subcontractors, agents, and affiliates, as well as the payment network displayed on your Volt Pay Card and its subcontractors, agents, and affiliates, may access certain transaction details to provide Google Pay, supply transaction data, detect and address fraud, comply with law and regulatory requests, respond to court orders, improve and promote Google Pay, and prepare business or technical performance reports.
Personal information that you provide directly to Google, a payment network, or another third party supporting Google Pay is governed by that party’s privacy policy.
07 Merchant Relationships and Disclaimers
Merchants may offer discounts, rebates, free shipping, or other benefits when payment is made through Google Pay (“Offers”). Each Offer is governed by terms between you and the merchant. We are not responsible for loss or damage arising from an Offer or your interaction with a merchant. Delivery, returns, warranties, and other matters relating to goods or services are solely between you and the relevant merchant.
We do not endorse or warrant any merchant accessible through Google Pay or any Offer made by a merchant.
08 Changes to These Terms
We may amend these Terms by providing reasonable notice where required. We may also update this posting from time to time. You should review this page periodically so that you understand the Terms currently applying to your use of a Volt Pay Card through Google Pay.
09 Intellectual Property
All intellectual property rights in Google Pay, including rights in text, graphics, software, photographs, images, video, sound, trademarks, and logos, belong to Google, us, our licensors, or other third parties.
These Terms do not grant you any right in intellectual property owned by Google, us, our licensors, or any third party. Adding a Volt Pay Card to Google Pay or using it through Google Pay does not give you any ownership rights.
10 Disclaimers of Warranty
Google Pay is provided by Google without warranty from us. Access to or use of a Volt Pay Card through Google Pay may be delayed, interrupted, or disrupted for reasons outside our control. To the extent permitted by applicable law, neither we nor our affiliates are responsible for claims arising from such delay, interruption, disruption, or similar failure.
We are not a party to the Google Pay terms between you and Google, do not own Google Pay, and do not provide any warranty for Google Pay. We are not responsible for its performance, maintenance, or support, or for claims concerning Google Pay, including product liability, regulatory compliance, consumer protection, or intellectual property infringement claims.
Questions or complaints about Google Pay itself, including intellectual property matters, should be directed to Google.
We do not recommend, endorse, or warrant the performance or operation of any Android Device. You are responsible for choosing your device and for its operation, performance, and associated costs.
11 Limitation of Liability
To the maximum extent permitted by applicable law, we, our processors, suppliers, licensors, and their respective affiliates, agents, directors, and employees will not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages—including loss of profits, goodwill, use, or data—arising from the use, inability to use, or unavailability of Google Pay, including use of a Volt Pay Card with Google Pay.
To the maximum extent permitted by applicable law, those parties assume no liability for content errors or inaccuracies; personal injury or property damage resulting from access to or use of Google Pay; interruption or cessation of transmission; malicious code transmitted by a third party; loss arising from content made available through Google Pay; or unlawful, offensive, or defamatory conduct by a third party.
12 Indemnity
To the extent permitted by applicable law, you will indemnify, defend, and hold us and our employees, directors, agents, affiliates, and representatives harmless from claims, costs, losses, damages, judgments, tax assessments, penalties, interest, and reasonable legal fees arising from: your actual or alleged breach of these Terms or our policies; wrongful, improper, fraudulent, or willful misuse of Google Pay; infringement of a third party’s privacy, publicity, or intellectual property rights; violation of applicable law; another person’s access to Google Pay using a biometric identifier, PIN, passcode, or security code enabled or disclosed by you; or a change in law or official regulatory direction affecting a Volt Pay Card or Google Pay.
13 Representations and Warranties
You represent and warrant that: any name provided during Google Pay Card Registration is yours; you are the cardholder or authorized user of each Volt Pay Card you add; your transactions comply with all laws, rules, and regulations applicable to you; you are authorized to receive notices, calls, and messages at the number you provide; you will not use a Volt Pay Card through Google Pay fraudulently or interfere with Google Pay; you will not permit an unauthorized third party to use your Card through Google Pay; and you will comply with these Terms.
14 Removal of Your Volt Pay Card from Google Pay
Follow Google Pay’s instructions to remove a Volt Pay Card if you no longer wish to use it through Google Pay. Remove every Volt Pay Card from an Android Device before disposing of or transferring that device. Removing a Card from Google Pay does not terminate the Card itself; termination remains governed by the Agreement.
15 Severability
If any provision or part of a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision or part will be severed and the remaining provisions will continue in full force and effect.
16 Governing Law
These Terms are governed by the same law that governs the Agreement.
17 Definitions
Capitalized words and expressions not defined below have the meanings given to them in the Volt Pay Terms of Use.
“Authorized User” means a person authorized by the holder of a Program Account to use a Volt Pay Card linked to that account.
“Android Device” means a device supporting the Android operating system that Volt Pay determines is eligible for registration of a Volt Pay Card with Google Pay. A device modified contrary to its manufacturer’s software or hardware guidelines, including by disabling controls commonly referred to as rooting or jailbreaking, is not eligible.
“Google Pay” means the mobile payment and digital wallet service created by Google that enables users to make payments using eligible devices and registered credit or debit cards.
“Card,” “Volt Pay Card,” or “Card Account” means an eligible payment card, or the account associated with that card, made available through Volt Pay.
“Program Account” means a Volt Pay account associated with one or more Volt Pay Cards.
“Volt Pay,” “we,” “our,” or “us” means Volt Pay and, where the context requires, its service providers and affiliates.
“you” or “your” means the company or person associated with the Program Account to which a Volt Pay Card added to Google Pay relates and, where the context requires, an Authorized User.
